Householders Legal Duty of Care

Since the 21st November 2005, every householder in the UK has been placed under a
duty to ensure that their waste is disposed of properly, and in accordance with the law.
Before this date, the duty only applied to businesses. Every householder is now required
to take reasonable measures to ensure that they only transfer their waste to an
authorised person. An authorised person is either a Registered Waste Carrier, or site that
holds a Waste Management Licence.

The duty of care was expanded to include householders to help in the fight against fly
tipping. If householders only use legitimate contractors, they can be satisfied that their
waste will be disposed of lawfully. Rogue traders will lose custom, and then be forced to
act within the law, or cease trading. Householders who fail to take reasonable measures,
regardless of whether the transfer led to the waste being fly tipped, commit a criminal
offence. The maximum penalty upon summary conviction is

When arranging any waste to be collected householders should:

Ask the contractor if they are a Registered Waste Carrier, and for their registration

Are you registered with the environment agency and do you have full liability insurance?

Why we prefer to assess before
quoting  -  to safeguard you.
When comparing service and getting quotes ask the following.
We don't want to place the emphasis on you to
assess a situation you may never have come across

We don't expect you to decide what is a lot or a little
clutter, or how big a van WE will need and is there
space for it, or how long a job may take.

We want to give you the best price possible, not one
that is hedged to take into account all the

We consider it dishonest how some firms have
hidden get out clauses allowing increases if you get it
We want to give a written binding quote.

We make an allowance on items we can assess but
cannot otherwise.

We want to give you peace of mind as to all the job
entails and how we will handle it .

We are happy to put in extra effort and go those
extra miles to make sure you are well served.
When comparing websites watch out for web pages that say one thing and another
called "terms and conditions" in another place (usually not obvious and in small print)
which contradicts or allows increases in price.

Wonder why they will not make an allowance for items of value

Also look carefully into National Associations. Make sure they are national and not set up
by and representing a company or companies trading under different names.

Always make sure you receive written confirmation of the quote and any terms.
We are proud of the fact that in 10 years we have
never missed an assessment appointment.

97% of quotes are accepted.

We have never let a client down by not turning up

or not removed everything commissioned to clear.

We are proud of our

We have never received a verbal or written complaint
about our service.

A Strange situation and a Customer
Town or Country Clearance were asked to give our
opinion on a situation that Mr Ward was worried
Save the Children UK  had been left a
house, a Solicitor had commissioned a house
clearance without asking for a quote and received
an exorbitant bill and paid it. Town or Country
were asked to give our opinion on the right price
for the task and received the following in thanks.
     Friday, 22 June,
Dear Mr Hall,

Thank you very much for looking at this for us and
for providing such comprehensive advice.

We were struggling to see why anyone would
instruct a company without at least getting a
rough quote in advance, and your email has
confirmed our fears that we have been
significantly overcharged. We would have
expected a similar fee to that as you have outlined
and will now go back to the solicitors and tell them
as such.

Many thanks again to you and Mr Douglas. We are
most grateful. Should we have any properties in
the region again, we will be sure to instruct Town
or Country Clearance.

Kind regards,
Tom Ward │ Legacy Case Manager │ Save
the Children UK
The truthful answer is maybe or maybe not

To conduct a house clearance we incur costs - labour, transport and tipping fees.
We need to these costs and make profit.  We want to help the client reduce fees, so the second
hand value of items is critical.  In over 80% of the house clearances we have conducted this value
reduced fees.

If the
second hand value
a) exceeds these costs we pay the client the difference
b) equals these costs we remove everything for free
c) is lower than our costs we reduce the fee in an agreed way.

If there is no second hand value then you pay for the total clearance. Any fee is only payable after
satisfaction and invoicing.

So the answer to the question is it depends on the size of property, its position, and many other
factors AND the quantity and value of the items inside.
Without an assessment we can't determine any of these factors, or the value of items, so any
telephone quote is meaningless.

After our
free assessment we put the facts into a written quote which is BINDING - any fee will
never go up BUT if we have significantly overestimated it will be reduced.

We will
RECYCLE as much as possible, and DONATE to any designated charity shops.
